The study presents a critical assessment of the sometimes forced assimilation of the succession of contracts as a case of legal transfer of an undertaking. It advocates a restrictive interpretation of this rule, which should be configured as a conditional and exceptional, only applicable when an autonomous production unit or economic entity is transferred in the specific case. Also in certain labour-intensive sectors or essentially a labour-intensive activity.
