This paper is based on the fact that the legal concept of employer for the purpose of determining liability in the labor field is not uniform but complex and varied. Therefore, it analyzes certain regulatory provisions relating to the identification of the employer's position for the purpose of attributing different types of liabilities, in order to also, with the support of case law, point out relevant elements when determining the scope of such liabilities in cases such as companies without legal personality, contracts and subcontracts of works, the illegal transfer of workers, the provision of workers through temporary employment agencies, groups of companies and also including a final reference to the highly topical issue relating to the so-called digital platforms.
