Institutional participation of "other" unions

The study deals with the institutional participation of the least representative trade unions in the Spanish industrial relations system. Firstly, it analyses the criterion of trade union representativeness as a criterion delimiting institutional participation itself. It then reviews the recognition of the institutional participation of these unions by constitutional and ordinary case law, highlighting how case law has been correcting and balancing the scope of greater representativeness in this area. Subsequently, institutional participation at the regional level is studied, analysing the treatment that regional regulations offer for the selection of less representative trade unions. Finally, a brief reference is made to the institutional participation of these unions in the regional councils for institutional participation.
