This study addresses the question of the complex boundary, from the point of view of labour law, of lawful outsourcing and the prohibited supply of employees. After a review of the criteria offered by the law for this purposes, special attention is paid to the criteria that have been used by case law, which is full of nuances. The study closes with conclusions and final reflections in which the author makes an essentially positive assessment of the result that emerges from the case law on this complex issue.
